Businesses in the same trade exchanging commercially sensitive information, in particular future pricing intentions, can harm competition, as it would make it easier for competitors to predict and align with each others’ behaviours, thereby allowing competitors to substitute practical cooerpation for effective competition. Such conduct may contravene the Competition Ordinance.

The Competition Commission has developed a series of educational materials to raise awareness of the topic. Members of the public are welcome to download the materials.
